Détails: Now the most populous minority group in the United States, Latino/as increasingly need guidance on the everyday issues that affect their economic livelihood, their freedom, and their equal rights to dignity and opportunity. This comprehensive guide is organized around the three flashpoints that contribute to the unique legal treatment of Latino/as-immigration status, language regulation, and racial/ethnic discrimination. These points are examined in the venues of everyday life for Latino/as-from discrimination in housing to discrimination and language regulation in the workplace and lack of protection for immigrant labor, to classrooms where the bilingual education debate rages, to the voting booth and the criminal justice system where Latino/as confront racial profiling and language barriers.

Détails: This innovative casebook approaches immigration law and policy from a public interest perspective with a special emphasis on issues of social justice. Along with cases and statutory material, Immigration Law and Social Justice employs a variety of materials from appellate cases, client examples, article excerpts, and hypotheticals. These materials not only provide the basic framework for immigration law, but also engage students with the greater social, political, and economic context necessary to understand the movement of immigrants to the United States, as well as the human impact of immigration law enforcement and administration. Through examples, notes and questions that raise the social, racial, and political questions of admission and enforcement, as well as discussion of public interest lawyers’ strategies, this casebook advances students’ understanding of the creative approaches used in the field. Détails: Since many legal disputes are battles over the meaning of a statute, contract, testimony, or the Constitution, judges must interpret language in order to decide why one proposed meaning overrides another. And in making their decisions about meaning appear authoritative and fair, judges often write about the nature of linguistic interpretation. In the first book to examine the linguistic analysis of law, Lawrence M. Solan shows that judges sometimes inaccurately portray the way we use language, creating inconsistencies in their decisions and threatening the fairness of the judicial system. Solan uses a wealth of examples to illustrate the way linguistics enters the process of judicial decision making: a death penalty case that the Supreme Court decided by analyzing the use of adjectives in a jury instruction; criminal cases whose outcomes depend on the Supreme Court's analysis of the relationship between adverbs and prepositional phrases; and cases focused on the meaning of certain words in the Constitution. Solan finds that judges often describe our use of language poorly because there is no clear relationship between the principles of linguistics and the jurisprudential goals that the judge wishes to promote. A major contribution to the growing interdisciplinary scholarship on law and its social and cultural context, Solan's lucid, engaging book is equally accessible to linguists, lawyers, philosophers, anthropologists, literary theorists, and political scientists.

Détails: A law professor and former prosecutor reveals how inconsistent ideas about violence, enshrined in law, are at the root of the problems that plague our entire criminal justice system—from mass incarceration to police brutality. We take for granted that some crimes are violent and others aren’t. But how do we decide what counts as a violent act? David Alan Sklansky argues that legal notions about violence—its definition, causes, and moral significance—are functions of political choices, not eternal truths. And these choices are central to failures of our criminal justice system. The common distinction between violent and nonviolent acts, for example, played virtually no role in criminal law before the latter half of the twentieth century. Yet to this day, with more crimes than ever called “violent,” this distinction determines how we judge the seriousness of an offense, as well as the perpetrator’s debt and danger to society. Similarly, criminal law today treats violence as a pathology of individual character. But in other areas of law, including the procedural law that covers police conduct, the situational context of violence carries more weight. The result of these inconsistencies, and of society’s unique fear of violence since the 1960s, has been an application of law that reinforces inequities of race and class, undermining law’s legitimacy. A Pattern of Violence shows that novel legal philosophies of violence have motivated mass incarceration, blunted efforts to hold police accountable, constrained responses to sexual assault and domestic abuse, pushed juvenile offenders into adult prisons, encouraged toleration of prison violence, and limited responses to mass shootings. Reforming legal notions of violence is therefore an essential step toward justice.

Détails: Whilst immigration policy is a highly controversial topic in the West, states continue to receive people who settle, whether as asylum-seekers or refugees, or as family members of existing migrants or labour migrants. Many who move violate the immigration rules either in entering a country or staying beyond the time allowed. The problems illegality entails for migrants shape much of the law and society scholarship in this area and this volume brings together the key articles which shape current thinking. The main topics covered include illegality, mercy and the language of deservingness; transnationality; family and identity; refugees and asylum-seekers.

Détails: To most Americans, the law-especially noncriminal law-is a mystery that only someone with a law degree can solve. Understanding Law in a Changing Society renders the complexity of law at a level that everyone can understand. The book walks readers through the structure of the legal system, different divisions of civil law, and the core concepts and distinctions that underlie contemporary legal thought. It also provides insight into the way law and social change affect one another. With this revised and updated third edition, the authors have incorporated an updated preface and a new introduction; outlined a "How to Brief a Case" section; included new case studies, readings, and "You be the Judge" features for selected chapters; and for the first time added a glossary of legal terms and key websites to the book. Important developments in judicial selection, the state secrets doctrine, and family law (including same sex marriage, child custody, and unwed fathers' rights) are highlighted.

Détails: A surprisingly understudied topic in international relations is gender-based asylum. Gender-based asylum offers protection from deportation for migrants who have suffered gender violence and persecution in their home countries. Countries are increasingly acknowledging that even though international refugee law does not include "gender" as a category of persecution, gender violence can threaten people's lives and requires attention. But Meghana Nayak argues that it matters not just that but how we respond to gender violence and persecution. Asylum advocates and the US government have created "frames," or ideas about how to understand different types of gender violence and who counts as victims. These frames are useful in increasing gender-based asylum grants. But the United States is negotiating the tension between the protection and the restriction of non-citizens, claiming to offer safe haven to persecuted people at the same time that it aims to control borders. Thus, the frames construct which migrants are "worthy" of protection. The effects of the asylum frames are two-fold. First, they leave out or distort the stories and experiences of asylum seekers who do not fit preconceived narratives of "good" victims. Second, the frames reflect but also serve as an entry point to deepen, strengthen, and shape the US position of power relative to other countries, international organizations, and immigrant communities. Who Is Worthy of Protection? explores the politics of gender-based asylum through a comparative examination of US asylum policy and cases regarding domestic violence, female circumcision, rape, trafficking, coercive sterilization and abortion, and persecution based on sexual and gender identity.

Détails: Mike Royko: The Chicago Tribune Collection 1984–1997 is an expansive new volume of the longtime Chicago news legend’s work. Encompassing thousands of his columns, all of which originally appeared in the Chicago Tribune, this is the first collection of Royko work to solely cover his time at the Tribune. Covering politics, culture, sports, and more, Royko brings his trademark sarcasm and cantankerous wit to a complete compendium of his last 14 years as a newspaper man. Organized chronologically, these columns display Royko's talent for crafting fictional conversations that reveal the truth of the small-minded in our society. From cagey political points to hysterical take-downs of "meatball" sports fans, Royko's writing was beloved and anticipated anxiously by his fans. In plain language, he "tells it like it is" on subjects relevant to modern society. In addition to his columns, the book features Royko's obituary and articles written about him after his death, telling the tale of his life and success. This ultimate collection is a must-read for Royko fans, longtime Chicago Tribune readers, and Chicagoans who love the city's rich history of dedicated and insightful journalism.

Détails: This volume of original work comprises a modest challenge, sometimes direct, sometimes implicit, to the mainstream Anglo-American conception of the discipline of medical ethics. It does so not by trying to fill the gaps with exotic minority interest topics, but by re-examining some of the fundamental assumptions of the familiar philosophical arguments, and some of the basic situations that generate the issues. The most important such situation is the encounter between the doctor and the suffering patient, which forms one of the themes of the book. The authors show that concepts such as the body, suffering and consent - and the role such concepts play within patients' lives - are much more complicated than the Anglo-American mainstream appreciates. Some of these concepts have been discussed with subtlety by Continental philosophers (like Heidegger, Ricoeur), and a secondary purpose of the volume is to apply their ideas to medical ethics. Designed for upper-level undergraduates and graduate students with some philosophical background in ethics, Reconceiving Medical Ethics opens up new avenues for discussion in this ever-developing field.
