Détails: As a critical, in-depth analysis of the law-making process, this book has no equal. It deals with all the stages and forms of law-making: - the preparation of legislation; - its passage through Parliament; - statutory interpretation; - the operation of the rules of precedent in judicial decision-making; - the many facets of judicial law-making; - the machinery of law reform. The new eighth edition covers the operation of EU law in the UK after Brexit. It also covers pre-Brexit events such as the unprecedented legislation by backbench MPs to stop a No Deal Exit from the EU and the two great Supreme Court decisions over the triggering of Brexit and the prorogation of Parliament. The books draws on a wide range of sources including important new empirical research such as Lord Sumption's 2019 Reith lectures (Trials of the State – Law and the Decline of Politics) and the work of Sir Geoffrey Palmer, former Prime Minister and Justice Minister of New Zealand on The Law Reform Enterprise. There are new sections on the attempt to control the size of the House of Lords, on whether Parliament should have a role in the selection of senior judges and on the topical question whether decisions of the courts on constitutional questions are 'legal' or 'political'.

Détails: Any student of American history knows of Washington, Jefferson, and the other statesmen who penned the documents that form the legal foundations of our nation, but many other great minds contributed to the development of the young republic's judicial system -- figures such as William Littell, Ben Monroe, and John J. Marshall. These men, some of Kentucky's earliest law reporters, are the forgotten trailblazers who helped establish the foundation of the state's court system. In Writing the Legal Record: Law Reporters in Nineteenth-Century Kentucky, Kurt X. Metzmeier provides portraits of the men whose important yet understudied contributions helped create a new common law inspired by English legal traditions but fully grounded in the decisions of American judges. He profiles individuals such as James Hughes, a Revolutionary War veteran who worked as a legislator to reform confusing property laws inherited from Virginia. Also featured is George M. Bibb, a prominent U.S. senator and the secretary of the treasury under President John Tyler. To shed light on the pioneering individuals responsible for collecting and publishing the early opinions of Kentucky's highest court, Metzmeier reviews nearly a century of debate over politics, institutional change, human rights, and war. Embodied in the stories of these early reporters are the rich history of the Commonwealth, the essence of its legal system, and the origins of a legal print culture in America.

Détails: In 2012, the Bombay High Court celebrated the 150th year of its existence. As one of three high courts first set up in colonial India in 1862, it functioned as a court of original and appellate jurisdiction during the British Raj for over 80 years, occupying the topmost rung of the judicial hierarchy in the all-important Bombay Presidency. Yet, remarkably little is known of how the court functioned during the colonial era. The historiography of the court is quite literally anecdotal. The most well known books written on the history of the court focus on humorous (at times, possibly apocryphal) stories about 'eminent' judges and 'great' lawyers, bordering on hagiography. Examining the backgrounds and lives of the 83 judges-Britons and Indians-who served on the Bombay High Court during the colonial era, and by exploring the court's colonial past, this book attempts to understand why British colonial institutions like the Bombay High Court flourished even after India became independent. In the process, this book will attempt to unravel complex changes which took place in Indian society, the legal profession, the law, and the legal culture during the colonial era.

Détails: There is currently no basic text in wildlife law suitable for the wide range of courses in wildlife conservation and animal welfare at both bachelors and masters level, or for the large number of people who work in conservation and animal welfare; The Laws Protecting Animals and Ecosystems fills the gap in this significant market for a basic law text applicable to students and professionals whose primary training is in biology but who require a basic understanding of the laws relating to the protection of animals and ecosystems. The text is applicable to a wide range of subjects, including wildlife conservation, animal handling, animal welfare, animal husbandry, and veterinary science. This foundational text supports those studying animal and ecosystem law by providing an overview of the basic legal principles, national and international laws, terminology, the legal mechanisms used to protect animals and ecosystems, and a compendium of the major animal welfare and conservation laws in major English speaking countries. Dr. Rees has been teaching wildlife law for 20 years and ecology for over 35 years and is ideally placed to write this book.

Détails: This volume examines the nature, function, development and epistemological assumptions of the legal case in an interdisciplinary context. Using the question of ‘reading’ as a guiding principle, it opens up new ways of understanding case law and the doctrine of precedent by bringing the law into dialogue with the humanities. What happens when a legal case is read not only by lawyers, but by literary critics, by linguists, by philosophers, or by historians? How do film makers and writers adapt and transform legal cases in their work? How might one interpret fiction in the context of the historical development of the common law? The essays in this volume test the boundaries of the legal case as a genre by inviting perspectives from other disciplines, and in doing so also raise more fundamental questions of what constitutes law and legal thinking. This book will be of interest to anyone seeking a better understanding of the common law, the humanities, and the intersection between them.

Détails: This title has been written with an underlying aim in mind – to document critical judicial interpretations relating to the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 in a wide variety of situations. The book annotates the statute section by section from the legal standpoint and offers a systematic exposition of the Act in the form of a narrative, properly arranged under relevant chapters and topical headings. The analytical sub-headings of the chapters, marginal notes and index at the end of the book will serve as excellent aids for easy reference. It traces the legislative history of the Act and fulfils the long-felt need for an introductory study of the Act. The citation of case law is judicious and up-to date. Provisions relating to recovery of provident fund arrears have been dealt with extensively by citing relevant case laws under the Income Tax (Certificate Proceedings) Rules, 1962 and the Civil Procedure Code, 1908. The book will serve as a valuable reference to judges and lawyers dealing with the law of Employees’ Provident Funds. It will also serve as a useful guide to Provident Fund Commissioners, Recovery Officers and other officers of the EPF Organisation working in the field.

Détails: This book is the first of two volumes devoted to the history of law in Canada. This volume begins at a time just prior to European contact and continues to the 1860s, while volume two will start with Confederation and end at approximately 2000. The history of law includes substantive law, legal institutions, legal actors and legal culture. The book assumes that since 1500 there have been three legal systems in Canada – the Indigenous, the French, and the English. At all times, these systems have co-existed and interacted, with the relative power and influence of each being more or less dominant in different periods. The history of law cannot be treated in isolation, and this book examines law as a dynamic process, shaped by and affecting other histories over the long term. The law guided and was guided by economic developments, was influenced and moulded by the nature and trajectory of political ideas and institutions, and variously exacerbated and mediated by inter-cultural exchange and conflict. These themes are apparent in this examination, and through most areas of law including family law, constitutional, commercial, land settlement and tenure, and criminal.

Détails: Through an examination of five plays by Shakespeare, Paul Raffield analyses the contiguous development of common law and poetic drama during the first decade of Jacobean rule. The broad premise of The Art of Law in Shakespeare is that the 'artificial reason' of law was a complex art form that shared the same rhetorical strategy as the plays of Shakespeare. Common law and Shakespearean drama of this period employed various aesthetic devices to capture the imagination and the emotional attachment of their respective audiences. Common law of the Jacobean era, as spoken in the law courts, learnt at the Inns of Court and recorded in the law reports, used imagery that would have been familiar to audiences of Shakespeare's plays. In its juridical form, English law was intrinsically dramatic, its adversarial mode of expression being founded on an agonistic model. Conversely, Shakespeare borrowed from the common law some of its most critical themes: justice, legitimacy, sovereignty, community, fairness, and (above all else) humanity. Each chapter investigates a particular aspect of the common law, seen through the lens of a specific play by Shakespeare. Topics include the unprecedented significance of rhetorical skills to the practice and learning of common law (Love's Labour's Lost); the early modern treason trial as exemplar of the theatre of law (Macbeth); the art of law as the legitimate distillation of the law of nature (The Winter's Tale); the efforts of common lawyers to create an image of nationhood from both classical and Judeo-Christian mythography (Cymbeline); and the theatrical device of the island as microcosm of the Jacobean state and the project of imperial expansion (The Tempest).

Détails: Recent theoretical and methodological innovations in the anthropological analysis of South Asian societies have introduced distinctive modifications in the study of Indian social structure and social change. This book, reporting on twenty empirical studies of Indian society conducted by outstanding scholars, reflects these trends not only with reference to Indian society itself, but also in terms of the relevance of such trends to an understanding of social change more generally. The contributors demonstrate the adaptive changes experienced by the studied groups in particular villages, towns, cities, and regions. The authors view the basic social units of joint family, caste, and village not as structural isolates, but as intimately connected with one another and with other social units through social and cultural networks of various kinds that incorporate the social units into the complex structure of Indian civilization. Within this broadened conception of social structure, these studies trace the changing relations of politics, economics, law, and language to the caste system. Showing that the caste system is dynamic, with upward and downward mobility characterizing it from pre-British times to the present, the studies suggest that the modernizing forces which entered the system since independence--parliamentary democracy, universal suffrage, land reforms, modern education, urbanization, and industrial technology--provided new opportunities and paths to upward mobility, but did not radically alter the system. The chapters in this book show that the study of Indian society reveals novel forms of social structure change. They introduce methods and theories that may well encourage social scientists to extend the study of change in Indian society to the study of change in other areas. Milton Singer (1912-1994) was Paul Klapper Professor of Social Sciences and professor of anthropology at the University of Chicago. He was a fellow of the Academy of Arts and Sciences. He was also chosen as a distinguished lecturer by the American Anthropological Association and was the recipient of the Distinguished Scholar Award of the Association for Asian Studies. Bernard S. Cohn (1918-2003) was Professor Emeritus of Anthropology at the University of Chicago. He was widely known for his work on India during the British colonial period and wrote many books on the subject of India including India: The Social Anthropology of a Civilization (1971), An Anthropologist among the Historians and Other Essays (1987), and Colonialism and its Forms of Knowledge (1996).
